Terms of Service

2.1 How It Works

• •Users register with their email address
• •Users can participate in selected partner offers
• •Users can invite others via a personal referral link
• •Upon meeting all conditions, users may request a reward

2.2 Reward Conditions

To be eligible for a reward (e.g., Apple AirPods Pro), all of the following conditions must be met:

• •The user has successfully completed at least one partner offer
• •At least three people invited by the user have registered and each completed at least one partner offer
• •All completions have been verified and confirmed by us
• •No cancellations or chargebacks on any partner offers

You are responsible for the security of your account. Access is provided via secure login links sent to your email address.

4.1 Participation

Participation in partner offers takes place directly with the respective partner. We only facilitate access to these offers.

4.2 Verification

Successful participation in a partner offer is manually reviewed by us. We reserve the right to reject participations that do not meet the conditions. The decision on verification is at our sole discretion.

4.3 Partner Terms

Participation in partner offers is also subject to the respective partner's terms and conditions. These should be reviewed before participation.

4.4 Cancellations and Chargebacks

Cancellations or chargebacks on partner offers will result in the disqualification of that participation. This may cause the loss of reward eligibility.

5.1 Referral Link

Each registered user receives a personal referral link. This can be shared to invite others.

5.2 Valid Referrals

A referral is considered valid when:

• •The invited person registers via the referral link
• •The invited person is an independent, real person
• •The invited person successfully completes at least one partner offer
• •No cancellation or chargeback occurs

5.3 Abuse

The following actions are prohibited and will result in immediate exclusion without reward eligibility:

6.1 Conditional Rewards

Rewards are conditional and will only be granted when all conditions have been met and verified by us. There is no legal entitlement to a reward. The decision to grant rewards is at our sole discretion.

6.2 Expiration of Reward Eligibility

Unredeemed reward eligibility may expire, particularly in cases of:

• •Account termination or suspension
• •Inactivity for more than 12 months
• •Violation of these Terms
• •Cancellations or chargebacks on partner offers

6.3 Delivery

After successful verification, the reward will be shipped. We use various suppliers to fulfill rewards and have no control over delivery times. Typical delivery times are 2-8 weeks but may vary depending on availability and supplier.

6.4 Substitute Rewards

We reserve the right to offer equivalent alternatives if the original reward is unavailable. The determination of equivalence is at our discretion.

6.5 Taxes and Duties

The user is responsible for any tax obligations, customs duties, or fees related to received rewards.

7.1 Limitation of Liability

THE PLATFORM AND ALL REWARDS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY. WE MAKE NO GUARANTEES REGARDING THE AVAILABILITY, QUALITY, OR DELIVERY TIME OF REWARDS.

Our liability is limited to intentional misconduct and gross negligence. In no event shall we be liable for indirect damages, lost profits, or consequential damages.

7.2 Partner Offers

We assume no liability for the content and services of partner offers. Responsibility lies with the respective partner.

7.3 Availability

We strive for high platform availability but cannot guarantee it. Maintenance and technical issues may lead to temporary restrictions.

8.1 Termination by User

You can terminate your account at any time by emailing joe@frey.club. Unredeemed eligibility expires upon termination.

8.2 Suspension by Us

We reserve the right to suspend or delete accounts without prior notice in case of violation of these Terms or suspected abuse. In such cases, all reward eligibility is forfeited.

11.1 Applicable Law

These Terms are governed by the laws of the State of Delaware, USA, excluding the UN Convention on Contracts for the International Sale of Goods. For users residing in the EU, mandatory consumer protection rights remain unaffected.

11.2 Jurisdiction

The place of jurisdiction for all disputes is Delaware, USA, to the extent permitted by law.

11.3 Severability

If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.

11.4 Online Dispute Resolution (EU)

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
